ORIGIN and KnowYourOrigin.com are the trade names under which we operate our professional genealogy research and consultation services (our "Services"). "We", "our", or "us" refers to ORIGIN. "You" or "your" means an adult client of our Services. The performance of services by ORIGIN for you, our client, is subject to the following terms and conditions, and your use of our services constitutes your acknowledgement that you have read, understand, accept, and agree to be bound by these Terms of Service and Conditions of Use.
 

1. GENERAL CONDITIONS
 

1.1 By agreeing to these Terms of Service, you represent that you are at least 18 years of age or older. You must be 18 and older to use this service.

The specific scope and deliverables of the services will be agreed upon in writing with the client prior to commencement.
 

2.2 All Services are subject to the availability and reliability of historical and genealogical records. Variables such as time allotted, common surnames, time period, location, and records availability may limit research outcomes. Therefore, ORIGIN cannot guarantee the identification of any specific ancestors, the achievement of particular results, or the completeness and accuracy of any family tree or genealogical report. ORIGIN is committed to applying its best professional efforts to each project.
 

2.3 ORIGIN may utilise third-party resources or databases, which may carry additional terms and fees for the client. Updates or ongoing services require a separate written agreement.
 

3. MODIFICATION TO SERVICES & FEES
 

We reserve the right to update, change, or discontinue any aspect of our services or pricing at our sole discretion, at any time, with or without prior notice.
 

4. DISCLAIMERS OF WARRANTIES & LIMITATION OF LIABILITY
 

4.1 No Guarantees for Services. In purchasing our Services, you are engaging ORIGIN to perform professional genealogical research and consultation on your behalf. ORIGIN conducts research in accordance with the highest professional standards. Due to variables that can limit success — including time allotted, common surnames, time period, location, and records availability — there is no guarantee that any specific or positive results will be obtained. You can count on us to always give our best effort on your behalf.
 

4.2 Fees and Use of Results Disclaimer. Our fees reflect the value of our research and consultation services. We strive to provide accurate and thorough research, but we cannot guarantee or ensure against any outcomes or risks associated with how you choose to use the information we provide.
 

4.3 No Warranties. To the fullest extent permitted by law, you acknowledge and agree that ORIGIN has not made, and does not make, any representations or warranties regarding the accuracy or completeness of our research results. We specifically disclaim any and all implied warranties of merchantability or fitness for a particular purpose. In no event shall ORIGIN be liable to you or any other person for any indirect, incidental, special, consequential, or punitive damages, including claims for loss of business, loss of profits, or damage to reputation.

4.5 Client Information Policy and Disclaimer. We will begin research with any individual, generation, or family line you choose. Verification may comprise your initial project but provides a reliable foundation for your family history.
 

4.6 Limitation of Liability. To the fullest extent permissible under applicable law, ORIGIN's total liability for any loss, damage, or injury arising out of or related to our services shall be limited to the amount you paid for those services, regardless of cause. If you require a higher liability limit, you must notify us in writing and request it, paying any additional fees as agreed upon in a separate rider to these Terms and Conditions.
 

4.7 Indemnity. You agree to indemnify ORIGIN against all liabilities, claims, and expenses that may arise from any breach of this Agreement by you, or otherwise as a result of your use of the Website or Services.
 

5. SUBMISSION OF USER COMMENTS & MATERIALS
 

5.1 Use and Disclosure of Submitted Content. If you provide us with materials such as testimonials, creative ideas, suggestions, or proposals, you agree that we may use these in any medium. We reserve the right to modify, share, or reference them without restriction. We are not required to keep such submissions confidential, pay compensation, or respond to any comments.

6.4 Governing Law. This Agreement is governed by the laws of the State of California and, to the extent applicable, the Federal law of the United States of America. You agree that any action to enforce this Agreement shall be brought in the state courts located in Los Angeles County, California.

This Agreement, including these Terms, the Privacy Statement, and any terms and policies expressly referenced herein, as well as any Services Agreement(s) executed by you and ORIGIN, shall constitute the complete understanding between you and ORIGIN, superseding any prior or contemporaneous agreements.
 

7. MODIFICATION OF TERMS OF SERVICE & CONDITIONS OF USE
 

We reserve the right at any time and at our sole discretion to modify these Terms and Conditions of Use. Modifications will be posted online at KnowYourOrigin.com or communicated to you via email. Your continued use of the Website and/or Services after such modifications constitutes your acknowledgement of and agreement to be bound by the updated Terms.
